Dispute Resolution & Arbitration

To the fullest extent permitted by law, by using the Site, you and Clarisonic agree that if a dispute arises between you and Clarisonic relating in any way to the Site or your use thereof, including common law or statutory claims, the dispute will be resolved through confidential, final, and binding individual arbitration; provided that either party may file suit in court seeking to enjoin infringement, misappropriation, or misuse of its intellectual property rights. YOU ARE GIVING UP THE RIGHT TO LITIGATE A DISPUTE IN COURT BEFORE A JUDGE OR JURY.

Opt-out: You may elect to opt-out (exclude yourself) from the final, binding arbitration procedure and waiver of class and representative proceedings specified in these Terms by sending a written letter to Clarisonic at Clarisonic Beauty Health Renew Company, Attn: Legal Americas Department, 518 Harrison Ave Unit 2018, Leadville, CO 80461 (the “Notice Address”), within thirty (30) calendar days of your initial agreement to these Terms. The letter must be signed personally by you or your legal guardian and specify: (1) your first and last name; (2) your mailing address; (3) your email address; and (4) your request to be excluded from the final, binding arbitration procedure.

CLASS ACTION WAIVER: YOU AND Clarisonic AGREE THAT EACH OF US MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION OR PRIVATE ATTORNEY GENERAL PROCEEDING. YOU ARE GIVING UP THE RIGHT TO COMMENCE OR PARTICIPATE IN CLASS AND REPRESENTATIVE ACTIONS.

JURY TRIAL WAIVER: If for any reason a claim proceeds in court rather than in arbitration, you and Clarisonic each waive any right to a jury trial. The exclusive jurisdiction and venue of any IP Protection Action or, if you timely provide Clarisonic with an Arbitration Opt-out Notice, will be the state and federal courts located in the Northern District of California.

Purchasing from the Website

Your electronic or telephone order is an offer to buy from Clarisonic. Clarisonic reserves the right not to accept an order at its sole discretion. Once you have submitted an order, you will receive an automatic e-mail confirming the details of your order. Such e-mail is a confirmation that the order has been received by Clarisonic and does not constitute acceptance of your order.

Payment for the goods you order must be made by American Express, MasterCard, Visa credit card, PayPal, Amazon Pay or Apple Pay. The prices and availability of the goods displayed on this Web site are subject to change without notice. Orders will only be accepted from and dispatched to addresses within the continental United States.

Repairs and Servicing

You may visit a Clarisonic Service Center to have your Clarisonic machine serviced and/or repaired. If you are unable to visit a Clarisonic Service Center, you may ship your Clarisonic machine to Clarisonic for service and/or repair. Prior to shipping, you must contact Clarisonic Customer Service to obtain a carrier shipping label and confirm your proof of purchase. If your machine is lost or damaged beyond repair while in Clarisonic’s possession, we will replace the machine at no cost to you.

Genuine Clarisonic parts ensure your machine continues to work as intended, and that your warranty remains intact. Each part or tool has a 1-year Limited Warranty. If the part or tool fails within 1-year of repair service, it will be replaced at no cost to you. The repair or replacement of your machine under warranty falls under the original warranty and will not extend the period of the warranty.

If your Clarisonic machine is out of warranty, you will be provided a quote estimating the cost of repairs after an inspection is completed. Before service can begin, you must confirm acceptance of the estimated cost of repairs. Payment is due immediately upon notice of completion of repair.

Limitation of Liability

Clarisonic IS NOT RESPONSIBLE FOR ANY FAILURES OR DELAYS IN PERFORMING UNDER THIS AGREEMENT THAT ARE DUE TO EVENTS OUTSIDE OF ITS REASONABLE CONTROL. EXCEPT AS EXPRESSLY PROVIDED HEREIN, Clarisonic WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU AGREE THAT FOR ANY LIABILITY RELATED TO THE PURCHASE OF PRODUCT, Clarisonic IS NOT LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE AMOUNT OF YOUR ORDER.

IN CONSUMER CASES, THE LIABILITY FOR (1) PERSONAL DEATH AND INJURY AND (2) FRAUD MAY BE WIDER THAN NEGLIGENCE CAUSED LOSS AND IN SUCH CASES Clarisonic DOES NOT SEEK TO EXCLUDE THIS LIABILITY.

If within 30 days of purchase you should find the same model currently advertised at a lower price by an authorized US Clarisonic retailer or by Clarisonic on a third party marketplace site, we’ll refund you the difference if the below details are satisfied. Machine must be the exact same model number as it appears on Clarisonic.online and in stock. Proof of advertised price by an authorized dealer is required.

Authorized new product dealers are limited to Amazon.online 1st Party, Home Shopping Network (HSN), Best Buy, Costco, Home Depot, Lowes, QVC, Sam’s Club, Crate & Barrel and Target. Machine must be new and in original packaging. It cannot be used, damaged, returned, open box, “close out”, “clearance” or a demonstrator machine. Clarisonic reserves the right to rescind this offer at any time and/or modify these terms and conditions as needed.

Hong Kong Law Applicable to Orders

Your orders will also be processed according to Hong Kong law。 In addition to the governing law provisions stated in these Terms (laws of the State of Illinois, United States of America), any order placed on this Site shall also be subject to and processed in accordance with the laws of Hong Kong. This dual-law framework applies to all aspects of order processing, including but not limited to payment, fulfillment, delivery, and dispute resolution related to your order. Where conflicts arise between applicable laws, the law most protective of consumer rights shall prevail.

Counterfeit Machines

Following receipt of your Clarisonic machine, if we inspect it and determine that it is not a genuine Clarisonic product (i.e. a counterfeit), you acknowledge and accept that Clarisonic will not (and is not obligated to) service the machine and may (in its sole discretion) elect to: arrange for the machine to be returned to you; or permanently retain or destroy the machine, in exchange for Clarisonic providing you with a letter confirming that the product is a counterfeit, which you may present to the seller of the product or your credit card company for the purposes of seeking reimbursement.

Notices to California Consumer Only

An estimate for repairs, as required (section 9844 of the California Business and Professions Code), shall be given to the customer by the service dealer in writing. The service dealer may not charge for work done or parts supplied in excess of the estimate without the prior consent of the customer.

A buyer of this product in California has the right to have this product serviced and repaired during the warranty period. If, after a reasonable number of attempts, the defect has not been fixed, the buyer may return this product for a replacement or a refund subject, in either case, to deduction of a reasonable charge for usage.
